BACKGROUND
Mayor Michael Wilson and the City Council, supported by a group of residents calling themselves People Pressing our Elected Officials to Protect our Living Environment (P.E.O.P.L.E.), have declared war on immigrants of this city, utilizing extremely racist arguments to conduct a defamation campaign against immigrants, mostly Mexicans, acusing them of using schools and hospitals without paying taxes, of not serving in the military, causing a housing crisis, taking job's away from citizens, and causing other economic problems.

The Mayor and council have already begun to implement illegal regulations, that officially went into effect on January 1, 2004. The regulations are directed at the immigrant population, which consists of mostly Mexicans, and the intent is to expel them from the city. Under these measures and as of this date, the City police will be able to detain immigrants anywhere in the city, fine them up to $500.00, and hold them for for 30 days. An area particularly targeted is the well known "The Muster Zone" on Throckmorton Street, where day laborers gather to wait for employers to pick them up.

Other areas affected by the regulations include the monitoring of apartments and/or houses where immigrants are suspected of living, and taxicab companies owned and/or operated by Latino drivers. In the case of cab companies, the Latinos are being required to demonstrate English proficiency to an investigating officer and provide proof of legal residence and verification of a clean criminal record. This process is carried out by the police against the suspected immigrant without the issuance of a moving violation or any other infraction of civil or criminal law.

The first step in the enforcement of these regulations was the closure of a space where day laborers congregate to wait for contractors offering day work. The area, now closed to immigrants, is known as "The Muster Zone" and is located on the borders of Throckmorton Street, between the street and the railway line. The land belongs to a Public properity and CONRAIL. This company has not yet commented publically about this issue.

In mid October the city police distributed leaflets stating the regulation prohibiting day laborers from using the space in question. These were followed by the posting of permanent announcements throughout the area.

The regulation names January 1, 2004, as the date of enforcement, and Freehold's immigrants are already undergoing harassment, detention and surveillance of their homes. Drivers are being arbitrarily stopped by police officials and recieve tickets saying: "Under Official Discretion." Some of the immigrants was forced to pull the Mexican flag stickers from their vehicles.

The regulations allowing such police activity seem to have been planned well in advance since the city approved the creation of a special police task force to conduct surveillance of homes some months ago.

Freehold City authorities have rejected any and all alternatives proposed by the immigrant committee and the Monmouth County Residents for Immigrants Rights, and other supporters, while at the same time describing supporters as "outside agitators" and refusing to meet with immigrant group lawyers.

Meanwhile, P.E.O.P.L.E. continues the surveillance of immigrant homes and vehicles with the complete support of city authorities. Everyday P.E.O.P.L.E. park a car outside of the Church where the workers organize thier work and resistance.

In response, a team of lawyers acting on behalf of the Immigrant Committee of Freehold filed a legal suit at the Federal District Court in Trenton, New Jersey on Tuesday December 30,2004. The suit states that, by their actions, Mayor Wilson and the Freehold City council are in violation of National and International law which guarantees the protection of immigrant rights.

We respectfully ask that you join us in solidarity with the Immigrant Workers of Freehold by adding your electronic signature to this document as individuals and as members of a group or association. Please include all your pertinent information, that is, name, group represented (as applies), address & email (group or individual), and a brief message of solidarity.

Furthermore, we respectfully ask that you distribute this document widely to any civic and/or religious association that is inclined to defend the rights of people against injustice and the violation of human rights.

Lastly, we ask that you return to us a copy of your signature and pertinent information so that we may forward your show of support to the Immigrant Workers Committee of Freehold, NJ. Mayor Wilson say the resistence is frivolous and he will reinforce the attacks.

We will be posting the latest developments in this case as news becomes available to us. Our eyes are on Freehold until the discretionary regulations persecuting immigrant workers have been abolished.

To the citizens and government of the United States,
To the citizens of Freehold and the county of Monmouth,
To the Citizens of the State of New Jersey,

To the National and International Immigrant community .
To National and International civil society,
To local, national, and international mass media,

Signatories, citizens, organizations, men, women, and children of civil, national and international society.

We denounce the terrorist wave that the authorities of Freehold New Jersey have unleashed against all the immigrants of this city, and we denounce the assault on the civil rights of every inhabitant in the city of Freehold, New Jersey.

We consider the discretionary regulations and their enforcement as constituting an attack against the freedom and Humanity, a shameful assault on all the inhabitants (citizen, resident and immigrant) of Freehold, New Jersey, and furthermore, this constitutes an attack against individual rights and the civil rights and liberties of the inhabitants of Freehold, New Jersey.

It violates the Clause of equality of the First Amendment of the Constitution of the United States and the rights for the immigrants and their Families, established in High commissioner of the Nations United for the Human rights.

We do strongly condemn the actions taken under the cover of said regulations as a flagrant violation of human rights of immigrants as guaranteed by the constitution of the United States and national and international laws on the rights of the immigrants and their families.

We recognize these expressions as violence and systemic aggression by the neoliberal model and an economic globalization which have been unleashed against humanity especially against those most vulnerable and unprotected, immigrants worldwide.

We demand that the authorities of Freehold, the state of New Jersey, and federal authorities of the United States immediately cancel all aforementioned regulations, measures, and ordinances against immigrants set to officially take effect beginning January 1, 2004.

We demand the strictest respect of immigrant human rights as sacrosanct within the constitution of the United States and international laws; and we demand respect for the civil rights of all inhabitants of Freehold, New Jersey.

We demand that the authorities of Freehold, the state of New Jersey, and all its operatives including the city police and special task force, immediately cease and desist the harassment of the immigrant community.

We demand that a suitable space be provided where journeymen and workers may congregate for the purpose of organizing to seek work.

We strongly condemn beforehand any fines, detainments, arrests or deportations that are applied against any immigrant or citizen of the city of Freehold or against anyone who is in solidarity with them.

We announce our position in order to mobilize and to declare publicly our demand for the cancellation of these discretionary measures, regulations and ordinances; and the immediate release of persons and cancellation of charges against anyone detained under these circumstances.

We declare our solidarity with the Committee of Workers for Progress and Social Welfare and the Monmouth County Residents Committee for Immigrants Rights, citizens, churches, and organizations of Monmouth County and the city of Freehold, New Jersey, who struggle for justice and peace. We understand the Mayor, City council and P.E.O.P.L.E. position do not represent the Freehold and Monmouth residents opinion.

We demanded the constitutional recognition of the rights of all undocumented immigrants under an approval in the Congress and PERMANENT RESIDENCE FOR ALL THE UNDOCUMENTED IMMIGRANTS, in terms of Justice and Dignity.

We are encouraged by the workers spirit to resist this terror and oppression with dignity, and to stand in solidarity with them always!

Firma Carta publica en solidaridad con los migrantes de Freehold NJ

Freehold es una ciudad en el Estado de New Jersey, en los Estados Unidos.

El Alcalde Michael Wilson y el Consejo de la Ciudad, apoyado por un grupo de residentes autollamado P.E.O.P.L.E. People pressing our Elected Oficials to Protect our Living Enviroment y que en español se traduciria como Personas presionando a nuestros oficiales electos para proteger nuestro medio ambiente. Han declarado la guerra a los inmigrantes de esta ciudad, con argumentos sumamente racistas y una campaña de difamación, han implementado una serie de medidas, y acciones ilegales que entrarian en efecto a partir del 1 de Enero del 2004 encaminadas a expulsar de la ciudad a todos lo inmigrantes, la mayoria de ellos mexicanos; Acusandolos de usar las Escuelas y Hospitales sin pagar impuestos, de no prestar servicio militar,de causar una crisis y escases de viviendas, de quitar los empleos a los residentes, de causar problemas economicos y de producir empleo.

Bajo estas medidas y a partir de esta fecha, la Policia de la Ciudad podra detener y multar hasta con $500 dolares a todos los inmigrantes que se encuentren en cualquier punto de la ciudad, seran detenidos o arrestados hasta por 30 dias, especialmente los trabajadores Jornaleros si se reunen en la zona conocida como "The Muster Zone"(Zona de confluencia) en la Throckmorton Street o en el frente de la tienda "6-12" a conseguir trabajo con contratistas que llegan por ellos todos los dias, o si en un apartamento o casa viven mas del numero de los que estan permitidos , y para las companias de Taxis, algunas de ellas de dueños y conductores latinos , les aplicaran mediadas especiales en las que les exigiran hablar, leer y escribir en ingles, asi como comprobar su residencia legal y verificar sus antecedentes penales, Esto y mas para los inmigrantes sin la necesidad de que hayan cometido algun delito.

El primer paso fue cerrar el espacio donde se reunian los jornaleros para esperar a los contratistas que les ofrecen trabajo por un dia, el espacio se conoce como "Muster Zone"(zona de confluencia) es un terreno baldio a la orilla de la Throckmorton Street, entre la calle y las vias del tren, el espacio es una parte propiedad publica y la mayor parte es propiedad de la compania de trenes CONRAIL. Hasta hoy esta compania han expresado nada al respecto. A mediados de octubre la Policia de la ciudad distribuyo el anuncio donde se prohibia a los jornaleros usar ese espacio, posteriormente instalaron anuncios fijos.

La comunidad inmigrante de Freehold no ha tenido que esperar la fecha, desde hace muchos dias ya estan sufriendo el acoso, al ser detenidos al conducir y al ser revisadas sus casas, los conductores detenidos han sido obligados a retirar las calcomanías alusivas a México de sus vehículos y Bajo el cargo de:'A discreción del Policia" se han expedido multas sin mensionar ninguna infraccion en el ticket("Under Police Discretion") . Todo parece haber sido planeado con anticipación, ya que antes de anunciar estas medidas el consejo de la ciudad habia aprobado una serie de reglas y creado un cuerpo policiaco para el caso de las viviendas.

Las autoridades de Freehold han rechazado tajantemente las alternativas de solucion presentadas por los migrantes y del Comité de residentes del Condado de Monmouth por los Derechos de los inmigrantes y de otros que los apoyan , a quienes ha calificado de Agitadores de fuera"Outsider agitators" y han rechazado sin públicamente tener una audiencia con los abogados de los migrantes.

Mientras tanto P.E.O.P.L.E. con el beneplácito de las autoridades vigilan y elaboran reportes de las viviendas y los vehículos de los migrantes para entregarcelos a la policia de la ciudad.Totos los dias estacionan un veiculo de vigilancia afuera de la Parroquia donde se reunen los migrantes para trabajar y organizar la resistencia.

Atravez de un grupo de abogados, los trabajadores y sus familias, y el comité de Residentes que los apoyan interpusieron una demanda legal contra la Ciudad en la corte federal de Trenton, Capital de New Jersey el Martes 30 de Diciembre del 2004.El mayor Wilson dice que esto es una Frivolidad y que el reforzara su postura.

La conducta del Alcalde y del Consejo de la Ciudad asi como del grupo racista de residentes P.E.O.P.L.E. de Freehold, viola la constitución de los Estados Unidos y las leyes nacionales e internacionales que protegen los derechos Humanos de los migrantes y atenta contra los derechos civiles de los habitantes de esta ciudad.

Solidarizate y apoya con tu firma la siguiente carta publica, envia tu nombre y el de tu organización, asi como el lugar y país donde resides para anexarla a las firmas en solidaridad con los trabajadores migrantes de freehold , las iglesias y el Comité de residentes de Monmouth County por los derechos de los migrantes. Nosotros te enviaremos información sobre los acontecimientos y desarrollo del caso.

La recoleccion de firmas estara abierta hasta que se anuncie públicamente la cancelacion definitiva de esta medidas y acciones.

Los abajo firmantes, migrantes, ciudadanos y organizaciones, hombres, mujeres y niños de la sociedad civil, nacional e internacional denunciamos la ola de terror que las autoridades de Freehold New Jersey han desatado contra todos los migrantes de esta ciudad y la agresión a los derechos civiles de los habitantes de la Ciudad de Freehold,NJ.

Consideramos que las medidas referidas y su aplicación constituyen un atentado contra la Libertad y contra la Humanidad ,Constituyen una vergüenza para los habitantes (Ciudadanos, residentes e inmigrantes) de Freehold, NJ; y Constituye un atentado contra las garantias individuales y los derechos y y libertades civiles de los habitantes dela ciudad de Freehold NJ.

Constituyen una accion selectiva y una flagarante violación a los derechos humanos de los migrantes consagrados en la constitución de los Estados Unidos y en las Leyes nacionales e internacionales sobre los derechos de los migrantes y sus familias.
Viola la Cláusula de igualdad de la Primera Enmienda de la Constitución de los Estados Unidos y Los derechos de los migrantes y sus Familias, establecidas en el Alto comisionado de las Naciones Unidas para los Derechos Humanos

Que es una expresión mas de la violencia y la úblicam sitematica que el modelo neoliberal y la globalización economica han destado contra la humanidad especialmente contra los mas desprotegidos, especialmente contra todos los migrantes de todo el mundo.

Demandamos a las autoridades de freehold y a las autoridades estatales y federales la anulacion inmediata de todas medidas anunciadas para entrar en vigor desde el 1 de enero del 2004 .

exigimos el estricto respeto a los derechos humanos de los migrantes consagrados en la constitución de los Estados Unidos y en las leyes internacionales, exigimos el respeto a los derechos civiles de los habitantes de Freehold.

Exigimos a las autoridades de Freehold y del estado de New Jersey
Se suspendan inmediatamente el acoso a la comunidad migrante a trabes de la policia de la ciudad y le exigimos proveer de un espacio adecuado a los Trabajadores úblicamen y todas las facilidades para su autoorganización.

Condenamos enérgicamente y de antemano cualquier multa, detencion, arresto o úblicament que se aplique contra cualquier migrante o ciudadano de la ciudad de Freehold o con quien con ellos se solidarize.

Anunciamos nuestra disposición a movilizarnos y manifestarnos úblicamente para exigir la anulacion de estas medidas y la inmediata liberación y anulacion de cargos si alguien es detenido bajo esas medidas.

Manifestamos nuestra mas amplia y comprometida solidaridad con el Comité de Trabajadores por el Progreso y el Bienestar Social, y con el Monmouth Residents comité for Immigrants Rights, ciudadanos, iglesias y organizaciones de Monmouth County y Freehold que luchan por la justicia y por la paz y los animamos a resistir con dignidad, con ellos estaremos siempre!
